Can You Get Emancipated Because of Emotional Abuse
My question involves emancipation laws for the State of: New York
1. I Fully understand the "regulations" of proving you can support yourself independently for said emancipation.
2. However, looking throughout many threads on here, many people are saying you must live on your own, What can you do if your parents and your parents use the law to refuse to let you leave?
3. Could you become emancipated if you WERE living on your own for 2 weeks, supporting yourself, but because of the law you were forced to return home REGARDLESS of whether or not you were proving the courts you were financially stable and independent?
4. Would I even have a chance of being considered emancipated A. for being out on my own independently (even if it was for 2 weeks) and B. because I am emotionally abused by my mother?

Hon, you have no chance at being emancipated. You have a history of running away, of truancy...and this tells the court that you're not mature enough to be emancipated.
Please explain though how you're financially stable.

I know it does not count as income to show im supporting myself but Ive been at my job for about a year now, I also receive survivor benefits from my fathers passing(until im 18) but have saved every single penny from it, other than my mother stealing it using it for half the rent which i hadnt agreed to her doing but had no choice in the matter and the running away (if you hadnt read my other response) was marked because my mother had lied about kicking me out. Truancy because I was told the wrong information by a school counselor who just started and obviously doesnt know what shes talking about. HOWEVER, if any of this DID count (the 2 weeks living on my own) could i count the emotional abuse to get out of my mothers house for starters?
And also, do the 2 weeks count in the first place?

You're not a candidate for emancipation.
You ran away for 2 weeks - and you have no proof of anything other than (in the eyes of the authorities, likely) being a wayward teenager who actually needs MORE adult supervision and not less.
Emancipation is not for teens who are unhappy at home.
It's for teens who, by no fault of their own (their parents were killed in a plane crash for example) need to have the legal ability to sign a lease, get the utilities turned on, support their siblings. They need the legal ability to do these things to survive.
Or, it's for the Miley Cyrus/Macauley Culkins of the world.
I'm sorry - but you're just NOT a candidate.

2. However, looking throughout many threads on here, many people are saying you must live on your own, What can you do if your parents and your parents use the law to refuse to let you leave? Then you can't get emancipated. It really is that simple. Emancipation is not a right or an entitlement.

No. Two weeks is not nearly enough to prove anything.
4. Would I even have a chance of being considered emancipated A. for being out on my own independently (even if it was for 2 weeks) and B. because I am emotionally abused by my mother? No. Emotional abuse is not a valid reason for emancipation.
